Castford provides a cloud-based financial planning, analysis, and operational intelligence platform. Our services include real-time dashboards, AI-powered reporting, data integration with third-party systems, team collaboration tools, and related features as described on our website. We reserve the right to modify, suspend, or discontinue features with reasonable notice.
3. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You agree to notify us immediately of any unauthorized access. Castford is not liable for losses arising from unauthorized use of your account.
4. Subscription and Billing
Access to the platform requires a paid subscription. By subscribing, you agree to pay all applicable fees as described in your selected plan. Subscriptions automatically renew at the end of each billing period unless cancelled. Fees are non-refundable except as required by law or as stated in our refund policy. We may adjust pricing with 30 days advance notice.

6. Your Data

You grant Castford a limited license to process Your Data solely for the purpose of providing the services. We will not access, use, or disclose Your Data except as necessary to operate the platform, comply with law, or as described in our Privacy Policy.
7. Intellectual Property
The platform, including its design, code, features, documentation, and branding, is the exclusive property of Castford and is protected by intellectual property laws. These Terms do not grant you any right, title, or interest in the platform beyond the limited right to use it in accordance with your subscription.

Each party agrees to protect the confidential information of the other party with the same degree of care it uses for its own confidential information. Confidential information does not include information that is publicly available, independently developed, or rightfully received from a third party without restriction.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASTFORD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
Castford does not provide financial, legal, tax, or investment advice. The insights, reports, and analyses generated by our platform are informational tools and should not be relied upon as professional advice. You are responsible for your own financial decisions.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASTFORD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, REGARDLESS OF THE CAUSE OF ACTION. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless Castford, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the platform, your violation of these Terms, or your violation of any third-party rights.
12. Termination
Either party may terminate the subscription in accordance with the billing terms. We may suspend or terminate your access immediately if you violate these Terms. Upon termination, your right to use the platform ceases. We will make Your Data available for export for 30 days following termination, after which it may be deleted.
13. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Delaware.
14. Dispute Resolution
Before initiating formal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation for a period of 30 days. If the dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.
15. Modifications
We may update these Terms from time to time. We will provide notice of material changes by posting the updated Terms on our website and, where appropriate, by email notification. Your continued use of the platform after changes take effect constitutes acceptance of the revised Terms.
16. General Provisions
If any provision of these Terms is held to be unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any provision shall not constitute a waiver. These Terms constitute the entire agreement between you and Castford regarding the use of our platform and supersede all prior agreements.
